Your Rights on Public Holidays

We’ve received concerning reports from members who have received misinformation about their rights on public holidays.

Let us be clear: for most SDA members, work on public holidays is voluntary. You do not have to work.

If you do work, you must receive the appropriate penalty rates.

There is also no such thing as a “black out period” on leave, even during periods like Easter and Christmas. All leave requests must be considered by your employer and only rejected if it is reasonable to do so.

SDA members have successfully campaigned for more public holidays and the right to voluntary work for many years, so it is important that workers understand and have the ability to assert their rights.

If you have been misled about your rights on public holidays, or you have any other questions, please contact your SDA Organiser or call us on (03) 9698 1400.
